Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of the Pukaar platform, including the website at pukaar.io, the web dashboard, APIs, and any related services (collectively, the "Service"), provided by Pukaar ("Pukaar", "we", "us", or "our").

By creating an account or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of a business or organisation, you represent that you have authority to bind that entity to these Terms.

If you do not agree to these Terms, do not use the Service.

2. Service Description

Pukaar is an AI-powered outbound voice call platform that enables e-commerce businesses to automate Cash on Delivery (COD) order confirmation calls. The Service allows you to upload or sync customer order data, launch confirmation campaigns, and receive automated call outcomes and analytics.

We may update, modify, or discontinue features of the Service at any time. We will provide reasonable notice of material changes that may affect your use of the Service.

3. Your Account

To access the Service, you must register for an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You must notify us immediately at legal@pukaar.io if you suspect unauthorised access to or use of your account. Pukaar is not liable for any loss or damage arising from your failure to protect your account credentials.

One account per business. You may not transfer your account to another person or entity without our written consent.

4. Your Responsibilities and Acceptable Use

4.1 Compliance with Laws

You are solely responsible for ensuring that your use of the Service complies with all applicable laws and regulations, including but not limited to: the Prevention of Electronic Crimes Act, 2016 (PECA); regulations issued by the Pakistan Telecommunication Authority (PTA); and any other consumer protection, data protection, or telemarketing laws applicable to your business and your customers.

4.2 Customer Consent

You represent and warrant that you have the lawful right and, where required by applicable law, the explicit consent of each person whose phone number you upload or sync to the Service. By submitting customer phone numbers to Pukaar, you are instructing us to make automated AI voice calls to those individuals on your behalf. You accept sole responsibility for any claims arising from those calls.

4.3 Prohibited Uses

You agree not to use the Service to:

  • Call individuals who have not placed an order with your business or who have opted out of marketing or automated communications.
  • Harass, deceive, threaten, or abuse call recipients.
  • Impersonate any person, brand, or organisation other than your own registered business.
  • Transmit spam, unsolicited commercial messages, or communications that violate applicable telemarketing laws.
  • Attempt to gain unauthorised access to any part of the Service or its underlying systems.
  • Reverse engineer, decompile, or extract source code from the Service.
  • Use the Service in any manner that could damage, disable, or impair the Service or interfere with other users.
  • Resell, sublicence, or redistribute access to the Service without our written consent.

4.4 Data Quality. You are responsible for the accuracy and legality of the data you upload. Pukaar is not responsible for calls made to incorrect or stale phone numbers included in your uploads.

5. Payment Terms

5.1 Subscription Plans

Pukaar offers a free trial and paid subscription plans as described on the pricing page. Paid plans are billed monthly in advance. Prices are quoted in US Dollars (USD).

5.2 Billing

Billing is processed through our payment provider, LemonSqueezy. By subscribing to a paid plan, you authorise LemonSqueezy to charge your payment method on a monthly basis. You must keep your payment information current. If a payment fails, we may suspend your access to the Service until payment is resolved.

5.3 Refunds

All payments are non-refundable except where required by applicable law. If you cancel a paid plan, you will retain access to the Service until the end of your current billing period. No partial-month refunds are issued.

5.4 Plan Limits

Each plan includes a monthly call limit. When you reach your limit, active campaigns will pause automatically. You may upgrade at any time to increase your limit. Unused calls do not roll over to the following month.

5.5 Cancellation

You may cancel your subscription at any time through the billing portal in your dashboard. Cancellation takes effect at the end of your current billing period.

6. Data Ownership and Processing

You retain ownership of all data you upload to the Service, including your customer data. By uploading data, you grant Pukaar a limited, non-exclusive licence to process that data solely for the purpose of delivering the Service to you.

Pukaar processes your data as a data processor on your behalf. You remain the data controller and are responsible for the lawfulness of processing, including having appropriate consent where required.

7. Intellectual Property

The Service, including all software, AI models, interfaces, visual designs, trademarks, and documentation, is owned by Pukaar and is protected by applicable intellectual property laws. Nothing in these Terms grants you any ownership rights in the Service.

You may not copy, modify, distribute, sell, or create derivative works based on the Service or any part of it without our prior written consent.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. AI voice calls involve probabilistic models; we do not guarantee any specific confirmation rate, call outcome, or reduction in return-to-origin rates.

You use the Service at your own risk. Results may vary depending on your product category, customer base, call timing, and other factors outside our control.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PUKAAR AND ITS OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL FEES YOU PAID TO PUKAAR IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) PKR 10,000.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, our liability is limited to the fullest extent permitted by law.

10. Indemnification

You agree to indemnify, defend, and hold harmless Pukaar and its officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law; (d) any claim by a third party (including your customers) arising from calls initiated through the Service at your instruction; or (e) any inaccuracy in data you provide to us.

11. Termination

Either party may terminate these Terms at any time. You may terminate by closing your account. We may terminate or suspend your access to the Service immediately, without prior notice, if you breach these Terms, engage in prohibited use, fail to pay applicable fees, or for any other reason at our sole discretion.

Upon termination, your right to access the Service ceases immediately. We will delete or return your data in accordance with our Privacy Policy.

12. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the Islamic Republic of Pakistan, without regard to its conflict of law principles.

Any dispute arising out of or in connection with these Terms shall first be subject to good-faith negotiation between the parties for a period of 30 days. If not resolved, disputes shall be submitted to the exclusive jurisdiction of the courts of Lahore, Pakistan.

13. General Provisions

Entire Agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Pukaar regarding the Service and supersede all prior agreements or understandings.

Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Waiver. Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of that right or provision.

Assignment. You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.

Notices. Legal notices to Pukaar should be sent to legal@pukaar.io.

14. Changes to These Terms

We may modify these Terms at any time. We will notify you of material changes by email or through a prominent notice in the dashboard at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Service and close your account before the effective date.
